Criticism of the way in which Europeans have treated the inhabitants of the non-European world in the course of European expansion has a long history, Three centuries before Christopher Columbus encountered the American Indians, European intellectuals and clergymen had criticized the treatment of the peoples whom the crusaders and other Europeans met as they moved outward from the heartland of European civilization.The connection between the sixteenth-century Spanish writers who criticized the Spanish conquest of the Americas and medieval writers who criticized the behavior of Europeans toward the non-Europeans they encountered on their borders, is more familiar. Yet, their criticism referred back to medieval legal traditions and arguments about the rights of infidels in the face of European expansion. However, it is the increased recognition of the importance of this connection that has inspired much new research in the field of medieval canon law.The most important theorist of what we now call "race relations", in the Middle Ages, was Sinibaldo Fieschi, a distinguished canon-lawyer, who became Pope Innocent IV (1243-54), whose pontificate is the starting point of this study. As a working canon-lawyer and pope, Innocent''s work provides an unusual insight into the whole development of Christian-infidel relations, for his work covers those who lived within Christian Europe, those who were recent converts to Christianity, and those who lived beyond the bounds of Christendom.As pope he initiated the Mongol mission, the first attempt to deal with the Mongol threat to Eastern Europe on a diplomatic level, and to convert the Mongols to Christianity. As a lawyer he was also the author of a commentary on the nature of a just war that became the basis for all future discussion of the rights of infidels who lived in the path of European expansion.A wide knowledge of both legal theory and papal practice blended in a single career and it was this union of these two traditions that formed the intellectual background of Vitoria and Las Casas, and the eminent critics who followed them.This is the first complete study of this subject, based upon a careful analysis of papal and legal sources. Papal sources included letters found in papal registers, including the unpublished Vatican Register 62 which contains only letters dealing with the problems raised by infidel societies. The legal sources include commentaries on the basic texts of canon law that bear on the status of infidels, as well as legal opinions written to deal with specific problems involving Christian-infidel relations.Although directed to specialists and students of this period, this work, original in concept and exceptionally well-written, is sure to find a far wider audience. The whole subject is important, and topical too, in view of the current interest in racism and race relations, itself the subject of the author''s Appendix.

Between 1532 and 1602, the works of Geoffrey Chaucer were published in no less than six folio editions. These were, in fact, the largest books of poetry produced in sixteenth-century England, and they significantly shaped the perceptions of Chaucer that would hold sway for centuries to come. But it is the stories behind these editions that are the focus of Megan L. Cook's interest in The Poet and the Antiquaries. She explores how antiquarians—historians, lexicographers, religious polemicists, and other readers with a professional, but not necessarily literary, interest in the English past—played an indispensable role in making Chaucer a figure of lasting literary and cultural importance. After establishing the antiquarian involvement in the publication of the folio editions, Cook offers a series of case studies that discuss Chaucer and his works in relation to specific sixteenth-century discourses about the past. She turns to early accounts of Chaucer's biography to show how important they were in constructing the poet as a figure whose life and works could be known, understood, and valued by later readers. She considers the claims made about Chaucer's religious views, especially the assertions that he was a proto-Protestant, and the effects they had on shaping his canon. Looking at early modern views on Chaucerian language, she illustrates how complicated the relations between past and present forms of English were thought to be. Finally, she demonstrates the ways in which antiquarian readers applied knowledge from other areas of scholarship to their reading of Middle English texts. Linking Chaucer's exceptional standing in the poetic canon with his role as a symbol of linguistic and national identity, The Poet and the Antiquaries demonstrates how and why Chaucer became not only the first English author to become a subject of historical inquiry but also a crucial figure for conceptualizing the medieval in early modern England.

Reimagining Christendom offers a fresh appraisal of these developments from a surprising and distinctive vantage point. Tracing the web of textual ties that connected the northern fringes of Europe to the Roman see, Joel D. Anderson explores the ways in which Norse writers recruited, refashioned, and repurposed the legal principles and official documents of the Roman church for their own ends.Drawing on little-known vernacular sagas, Reimagining Christendom is populated with tales of married bishops, fictitious and forged papal bulls, and imagined canon law proceedings. These narratives, Anderson argues, demonstrate how Norse writers adapted and reconfigured the institutional power of the church in order to legitimize some of the thoroughly abnormal practices of their native bishops. Characters became an inexhaustible form of common property, despite their patent authorship. This interest sparked demand for both the latest hits of the London stage and a body of plays centered on patriotic (and often partisan) British themes. As relations between the crown and the colonies soured, the texts of these plays evolved into a common frame of reference for political arguments over colonial policy. Royals and gentry alike commissioned lavish manuscript copies of these works, copies whose images were integral to the rising prestige of English as a literary language. Yet despite the significance of these images, manuscript illuminators are seldom discussed in the major narratives of the development of English literary culture.The newly enlarged scale of English manuscript production generated a problem: namely, a need for new images. Not only did these images need to accompany narratives that often had no tradition of illustration, they also had to express novel concepts, including ones as foundational as the identity and suitable representation of an English poet. In devising this new corpus, manuscript artists harnessed visual allusion as a method to articulate central questions and provide at times conflicting answers regarding both literary and cultural authority.Sonja Drimmer traces how, just as the poets embraced intertexuality as a means of invention, so did illuminators devise new images through referential techniques—assembling, adapting, and combining images from a range of sources in order to answer the need for a new body of pictorial matter. By the end of the Middle Ages, the ius commune—the combination of canon and Roman law—had formed the basis for all law in continental Europe, along with its patriarchal system of categorizing women. Throughout medieval Europe, women regularly found themselves in court, suing or being sued, defending themselves against criminal accusations, or prosecuting others for crimes committed against them or their families. Yet choosing to litigate entailed accepting the conceptual vocabulary of the learned law, thereby reinforcing the very legal and social notions that often subordinated them.In The Measure of Woman Marie A. Kelleher explores the complex relationship between women and legal culture in Spain''s Crown of Aragon during the late medieval period. Aragonese courts measured women according to three factors: their status in relation to men, their relative sexual respectability, and their conformity to ideas about the female sex as a whole. Yet in spite of this situation, Kelleher argues, women were able to play a crucial role in shaping their own legal identities while working within the parameters of the written law. The Measure of Woman reveals that women were not passive recipients—or even victims—of the legal system. European exploration and conquest expanded exponentially in the late fifteenth and sixteenth centuries, and as the horizons of imperial experience grew more distant, strategies designed to convey the act of witnessing came to be a key source of textual authority. From the relación to the captivity narrative, the Hispanic imperial project relied heavily on the first-person authority of genres whose authenticity undergirded the ideological armature of national consolidation, expansion, and conquest. At the same time, increasing pressures for religious conformity in Spain, as across Europe, required subjects to bare themselves before external authorities in intimate confessions of their faith. Emerging from this charged context, the unreliable voice of the pícaro poses a rhetorical challenge to the authority of the witness, destabilizing the possibility of trustworthy representation precisely because of his or her intimate involvement in the narrative.In Knowing Fictions , Barbara Fuchs seeks at once to rethink the category of the picaresque while firmly centering it once more in the early modern Hispanic world from which it emerged. Venturing beyond the traditional picaresque canon, Fuchs traces Mediterranean itineraries of diaspora, captivity, and imperial rivalry in a corpus of texts that employ picaresque conventions to contest narrative authority. What emerges is a new understanding of the book at once as a material good, existing within the economies of buying, selling, giving, and receiving; as an object of reverence and a medium for the performance of reading; and as an organizational system for word, sound, and image.The product of extensive archival research, The Pilgrim and the Bee brings together the disciplines of book studies and performance theory to reconsider the literary history of early America. Brown focuses on the reader''s body, carefully studying reading practices during the first three generations of English settlement, with particular emphasis on the way such practices operated in the social rituals of the Massachusetts Bay Colony. Understanding Puritanism as a style of piety predicated on access to texts, he describes a canon of texts (devotional "steady sellers") that, with the Bible, served as conduct literature for pious readers. These devotional manuals were reprinted and read frequently and helped to shape the social identities of gender, race, class, faith, and age. To Brown, seventeenth-century devotional readers are both pilgrims, treating texts as continuous narratives of redemptive journeying, and bees, treating texts as flowers or hives, as spatial objects where information is extracted and deposited discontinuously.

To seek sanctuary from persecution by entering a sacred space is an act of desperation, but also a symbolic endeavor: fugitives invoke divine presence to reach a precarious safe haven that imbues their lives with religious, social, or political significance. In medieval England, sanctuary was upheld under both canon and common law, and up to five hundred people sought sanctuary every year. What they found, however, was not so much a static refuge as a temporary respite from further action—confession and exile—or from further violence—jurisdictional conflict, harrying or starvation, a breaching of the sanctuary.While sanctuary has usually been analyzed as part of legal history, in Uncertain Refuge Elizabeth Allen explores the symbolic consequences of sanctuary seeking in English literary works—miracle collections, chronicles, romances, and drama. She ponders the miracle of a stag''s escape from the hunt into a churchyard as well as the account of a fallen political favorite who gains a sort of charisma as he takes sanctuary three times in succession; the figure of Sir Gawain, seeking refuge in a stark land far from the court and Robin Hood, hiding in his local forest refuge among his Merry Men. Her consideration of medieval sanctuary extends to its resonances in a seventeenth-century play about the early Tudor usurper Perkin Warbeck and even into modern America, with the case of a breach of sanctuary in southwest Georgia in 1963, when sheriffs took over a voter registration meeting in a local church. Uncertain Refuge illuminates a fantasy of protection and its impermanence that animated late medieval literary culture, and one that remains poignantly alive, if no longer written into law, in today''s troubled political world.

In tracing the origins of the modern human-rights movement, historians typically point to two periods: the 1940s, in which decade the Universal Declaration of Human Rights (UDHR) was ratified by the United Nations General Assembly; and the 1970s, during which numerous human rights nongovernmental organizations (NGOs), most notably Amnesty International and Médecins Sans Frontières, came into existence. It was also in the 1970s, Sarita Cargas observes, when the first classes in international human rights began to be taught in law schools and university political science departments in the United States.Cargas argues that the time has come for human rights to be acknowledged as an academic discipline. She notes that human rights has proven to be a relevant field to scholars and students in political science and international relations and law for over half a century. It has become of interest to anthropology, history, sociology, and religious studies, as well as a requirement even in social work and education programs. However, despite its interdisciplinary nature, Cargas demonstrates that human rights meets the criteria that define an academic discipline in that it possesses a canon of literature, a shared set of concerns, a community of scholars, and a methodology.In an analysis of human rights curricula in Australia, Canada, the United Kingdom, and the United States, Cargas identifies an informal consensus on the epistemological foundations of human rights, including familiarity with human rights law; knowledge of major actors including the United Nations, governments, NGOS, and multinational corporations; and, most crucially, awareness and advocacy of the rights and freedoms detailed in the articles of the UDHR. The second half of the book offers practical recommendations for creating a human rights major or designing courses at the university level in the United States.

If scholars no longer necessarily find the essence and origins of what came to be known as Christianity in the personality of a historical figure known as Jesus of Nazareth, it nevertheless remains the case that the study of early Christianity is dominated by an assumption of the force of Jesus's personality on divergent communities. In The Godman and the Sea, Michael J. Thate shifts the terms of this study by focusing on the Gospel of Mark, which ends when Mary Magdalene, Mary the mother of James, and Salome discover a few days after the crucifixion that Jesus's tomb has been opened but the corpse is not there. Unlike the other gospels, Mark does not include the resurrection, portraying instead loss, puzzlement, and despair in the face of the empty tomb. Reading Mark's Gospel as an exemplary text, Thate examines what he considers to be retellings of other traumatic experiences—the stories of Jesus's exorcising demons out of a man and into a herd of swine, his stilling of the storm, and his walking on the water. Drawing widely on a diverse set of resources that include the canon of western fiction, classical literature, the psychological study of trauma, phenomenological philosophy, the new materialism, psychoanalytic theory, poststructural philosophy, and Hebrew Bible scholarship, as well as the expected catalog of New Testament tools of biblical criticism in general and Markan scholarship in particular, The Godman and the Sea is an experimental reading of the Gospel of Mark and the social force of the sea within its traumatized world. More fundamentally, however, it attempts to position this reading as a story of trauma, ecstasy, and what has become through the ruins of past pain.

From Puritan Execution Day rituals to gangsta rap, the black criminal has been an enduring presence in American culture. To understand why, Jeannine Marie DeLombard insists, we must set aside the lenses of pathology and persecution and instead view the African American felon from the far more revealing perspectives of publicity and personhood. When the Supreme Court declared in Dred Scott that African Americans have "no rights which the white man was bound to respect," it overlooked the right to due process, which ensured that black offenders—even slaves—appeared as persons in the eyes of the law. In the familiar account of African Americans'' historical shift "from plantation to prison," we have forgotten how, for a century before the Civil War, state punishment affirmed black political membership in the breach, while a thriving popular crime literature provided early America''s best-known models of individual black selfhood. Before there was the slave narrative, there was the criminal confession. Placing the black condemned at the forefront of the African American canon allows us to see how a later generation of enslaved activists—most notably, Frederick Douglass—could marshal the public presence and civic authority necessary to fashion themselves as eligible citizens. Yet for all its practical reach, which extended over centuries and as far as the Spanish New World, it is an unusual text, argues Jesús R. Velasco, one that introduces canon and ecclesiastical law in the vernacular for explicitly secular purposes, that embraces intellectual disciplines and fictional techniques that normally lie outside legal science, and that cultivates rather than shuns perplexity.In Dead Voice , Velasco analyzes the process of the Siete Partidas ''s codification and the ways in which different cultural, religious, and legal traditions that existed on the Iberian Peninsula during the Middle Ages were combined in its innovative construction. Rather, according to Bennett, they involved clashing understandings of diplomacy, sovereignty, and politics. A second story recounts how Jesus transformed mud into living birds, while yet another has Joseph telling Mary to keep Jesus in the house so that no one else gets hurt. What was life really like in the household of Joseph, Mary, and little Jesus? The canon of the New Testament provides few details, but ancient Christians, wanting to know more, would turn to the texts we know as the "Infancy Gospels."The Infancy Gospel of Thomas is a collection of stories from the mid-second century C.E. describing events in the life of Jesus between the ages of five and twelve. The Proto-gospel of James , also dating from the second century, focuses on Mary and likewise includes episodes from her childhood. These gospels are often cast aside as marginal character sketches, designed to assure the faithful that signs of divine grace cropped up in the early years of both Mary and Jesus. Christopher A. Frilingos contends instead that the accounts are best viewed as meditations on family. Both gospels offer rich portrayals of household relationships at a time when ancient Christians were locked in a fierce debate about family—not only on the question of what a Christian family ought to look like but also on whether Christians should pursue family life at all.Describing the conflicts of family life, the gospels present Jesus, Mary, and Joseph in moments of weakness and strength, reminding early Christians of the canyon separating human ignorance and divine knowledge. According to Frilingos, the depicted acts of love and courage performed in the face of great uncertainty taught early Christian readers the worth of human relationships.
